Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

These Terms & Conditions apply to all purchases made through Plant Nest and prevail over any other Plant Nest policies, webpages, marketing material, or communications.

Where there is any inconsistency, these Terms & Conditions take precedence.

 

Order Processing

Plant Nest offers a curated range of live plants available for purchase online.

  • Plants are supplied specifically for each customer after an order is placed.
  • Plant Nest does not hold physical inventory for immediate dispatch.
  • Once an order is confirmed and preparation has commenced, the order cannot be cancelled or amended.

By placing an order, you acknowledge and accept this process.

 

Live Plant Acknowledgement

Plants are living products and natural variation is inherent.

You acknowledge that the following do not constitute a fault:

  • Minor leaf loss, bent stems, soil displacement, or cosmetic marks from transport
  • Seasonal changes, dormancy, or deciduous plants supplied without foliage
  • Variations in size, shape, colour, or density compared to website images

All images, dimensions, and descriptions are indicative only and provided as a guide.

 

Pricing & Availability

All pricing and availability are subject to confirmation at the time of ordering.

If a plant becomes unavailable after purchase, Plant Nest may, at its discretion:

  • Offer a suitable substitute of similar value, or
  • Refund the unavailable item only

Plant Nest is not liable for downstream availability changes.

 

Delivery

Delivery Method

Delivery is arranged via professional plant transport services.

  • Delivery timeframes are estimates only and not guaranteed.
  • Deliveries are scheduled based on location, access, and route efficiency.


Authority to Leave

If no one is present at delivery, plants will be left in a safe, accessible location at the delivery address.

Plant Nest is not responsible for loss, theft, or damage after delivery.

 

Delivery Completion & Risk Transfer

Delivery is deemed complete when:

  • Plants are delivered to the nominated address, and
  • Delivery confirmation or photographic evidence is obtained

Risk transfers to the customer at this point.

 

Inspection & Claims

Customers must:

  • Inspect plants immediately upon delivery
  • Notify Plant Nest within 24 hours of delivery of any issues
  • Provide clear photographic evidence showing:
    • The full plant
    • Close-up of the issue
    • Pot or identifying label

Claims lodged outside this timeframe will not be accepted.

 

30-Day Customer Happiness Guarantee (Clarified)

Plant Nest offers a 30-Day Customer Happiness Guarantee in addition to your statutory rights. This guarantee applies only to plant health issues that are clearly attributable to transit or supply conditions.

The guarantee does not apply to issues caused by:

  • Incorrect watering or planting
  • Soil conditions
  • Weather exposure
  • Delay in planting after delivery
  • Lack of aftercare

 

Remedies

If a claim is accepted, Plant Nest may, at its discretion:

  • Replace the affected plant, or
  • Refund the purchase price of the affected plant only

Delivery fees, labour costs, landscaping costs, and consequential losses are non-refundable.

 

Limitation of Liability

To the maximum extent permitted by law:

  • Plant Nest’s liability is limited to the value of the affected plant only
  • Plant Nest is not liable for indirect, incidental, or consequential loss

 

External Factors

Plant Nest is not liable for loss or delay caused by:

  • Weather events
  • Site access restrictions
  • Biosecurity or quarantine requirements
  • Transport disruptions beyond reasonable control


Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.
